Please read these terms carefully. They govern your access to and use of Cat Build Mart services.

Acceptance of Terms
By accessing Cat Build Mart, creating an account, submitting an RFQ, uploading a BOQ, placing an order, booking rental equipment, submitting a property enquiry or otherwise using the platform, you agree to these Terms & Conditions.
If you do not agree, do not use Cat Build Mart.

Eligibility
Marketplace Model. Cat Build Mart may facilitate transactions involving independent:
- material suppliers;
- manufacturers;
- distributors;
- dealers;
- rental providers;
- equipment owners;
- logistics providers;
- property owners;
- developers/promoters;
- real-estate agents; and
- other service providers.
Unless a listing expressly states that Cat Build Mart itself is the seller/provider, the contract for the relevant product or service is between the buyer and the identified seller/provider.
Cat Build Mart provides marketplace technology, transaction facilitation and related support. Nothing in these Terms removes obligations imposed on Cat Build Mart by applicable law.
Eligibility. Users must:
- be legally competent to enter into the relevant transaction;
- provide accurate information;
- use the platform only for lawful purposes; and
- comply with applicable laws.
Business users represent that they are authorised to act for their organisation.
Account Responsibilities
You are responsible for:
- maintaining accurate account information;
- protecting login credentials;
- activities carried out through your account; and
- promptly notifying Cat Build Mart of suspected unauthorised use.
Orders & Pricing
Product Listings. Product information may be supplied by sellers, manufacturers or distributors. Listings may contain: Brand, Grade, Size, Quantity, Specification, Price, GST information, MOQ, Availability, Delivery details, Warranty information.
For a sale by description, Indian sale-of-goods law contains requirements concerning conformity with description and, in applicable cases, quality, fitness and sample.
Direct Ordering. Where a product supports direct ordering: user selects product and quantity; applicable price and charges are shown; user provides delivery information; payment is completed where required; order confirmation is issued; seller fulfils the order.
An order may be subject to seller confirmation, stock availability, payment verification, serviceability and other clearly disclosed conditions.
Request for Quote / RFQ. For quotation-based procurement: buyer submits the requirement; Cat Build Mart may route it to eligible suppliers; suppliers submit quotations; buyer may compare quotations; buyer selects a quotation; final order/contract is created.
Unless expressly stated otherwise, submission of an RFQ itself does not constitute acceptance of a quotation or purchase contract.
BOQ Upload. The BOQ functionality enables users to submit multiple material requirements. Users are responsible for reviewing extracted items, quantities, units, specifications, and quotation requirements before confirming an RFQ/order.
Any automated extraction or AI-assisted parsing should be treated as an assistance tool and verified by the user before procurement.
Prices and Taxes. Prices may be displayed as fixed/direct price, indicative price, starting price, or price on request. Before final order confirmation, mandatory charges applicable to the transaction should be disclosed as required, including relevant taxes and delivery charges. GST will be applied in accordance with applicable law.
Where Cat Build Mart qualifies as an e-commerce operator for particular transactions, applicable GST/TCS obligations may arise under the CGST framework.
Payments
Available payment methods may include approved methods integrated into the platform.
Users must not:
- use unauthorised payment instruments;
- initiate fraudulent chargebacks;
- manipulate payment systems; or
- make unlawful transactions.
Prohibited Use
Order Cancellation. Cancellation availability depends on the stage of fulfilment and product type.
No cancellation charge will be imposed in a manner prohibited by applicable law. Under India's e-commerce rules, a consumer should not be charged a cancellation fee where the platform itself would not bear a similar charge for unilateral cancellation.
Rental Refunds
Rental listings may have separate terms governing: duration; daily/weekly/monthly rates; operator charges; mobilisation/demobilisation; fuel; overtime; security deposit; damage; inspection; breakdown; replacement; extension; cancellation.
The specific rental quotation/order governs those commercial terms.
Users must use rented equipment only through properly authorised and competent persons and in accordance with applicable safety and operating requirements.
Third-Party Services
Cat Build Mart real-estate functionality primarily provides discovery, listing and enquiry/lead facilitation unless expressly stated otherwise.
Property users should independently verify: ownership/title; encumbrances; approvals; layout approval; planning permission; building approval; patta/revenue records where relevant; measurements; access; taxation; RERA registration where applicable; and legal documents.
Applicable projects cannot lawfully be advertised/offered in circumstances requiring RERA registration without such registration, and real-estate agents also have statutory registration/functions under RERA.
CATBM verification of a listing must not be interpreted as a legal title certificate unless CATBM expressly provides a separate professional verification report stating its scope.
Intellectual Property
Seller Obligations. Sellers must: provide accurate business information; maintain required licences/registrations; supply genuine goods; accurately describe products; honour accepted orders; issue legally required invoices; comply with applicable tax requirements; fulfil warranties; address complaints; and comply with consumer law.
Sellers must not refuse applicable returns/refunds for goods or services that are defective, deficient, spurious, inconsistent with the advertised characteristics or delivered late where law requires the remedy.
Reviews and Ratings. Users may post genuine reviews based on actual experience. Prohibited content includes: fake reviews, paid deceptive reviews, defamatory content, impersonation, manipulated ratings.
Intellectual Property. Cat Build Mart's software, designs, trade names, graphics and proprietary content may be protected by applicable intellectual-property laws. Third-party brands remain the property of their respective owners.
Limitation of Liability
Prohibited Use. Users shall not: commit fraud; impersonate others; scrape the platform without authorisation; interfere with platform security; upload malicious software; submit false documentation; misuse quotations; manipulate reviews; violate third-party rights; or use Cat Build Mart for illegal transactions.
Availability. We aim to maintain service availability but may suspend or modify services for maintenance, upgrades, security, infrastructure failure, force majeure, or legal requirements.
Limitation of Liability. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.
Subject to applicable law, Cat Build Mart will not be responsible for indirect or consequential losses arising from matters outside its reasonable control or from independent seller/provider conduct where CATBM is legally acting only as intermediary.
This clause must always be read subject to the Consumer Protection Act, product liability provisions and other mandatory Indian law.

Consumer complaints will be acknowledged within the legally prescribed period and processed through our grievance mechanism.
Contact Us
Governing Law. These Terms are governed by the laws of India.
Subject to mandatory consumer rights and applicable statutory jurisdiction, disputes will be subject to courts/tribunals having lawful jurisdiction.
Consumer legislation allows statutory consumer remedies, and CATBM does not contractually attempt to remove those rights. The National Consumer Helpline also provides a pre-litigation grievance channel.
